Smith was arrested at a June 22 school board meeting several weeks after he said his daughter was raped by a fluid student in the school bathroom. The student, a 15-year-old boy, was charged in the case with two counts of forced sodomy and later arrested. He was then fitted with an ankle monitor and transferred to another school in Ashburn, where he was charged with committing another sexual assault against another student in October.
Biberaj told Fox 5 on Friday that the decision to transfer the student to another school came because he had no history of such behavior at the time, and she asked the audience to “be patient” and refrain from judgment until “all the facts” in this case are revealed.
Meanwhile, Smith’s attorney announced his intention to sue the school district for its handling of the case and his own arrest at the school board meeting. He was sentenced in this case to 10 days in prison, all suspended, subject to one year of good behavior.

According to The Daily Wire, Biberaj has appeared in court to personally prosecute Smith, although he knows the details of the case involving his daughter. Smith’s attorney, Elizabeth Lancaster, told the outlet she had known Biberaj for “years” and was shocked when the charges against Smith were not dropped.
“The idea that they would actually seek jail time, I guess in my 15 years the number of times I saw that happen would be zero,” Lancaster said. “The idea that this is someone we need to put in a cage amazed me given the social justice reform she advocated. I was blown away.”
The Daily Wire article appears to suggest that Biberaj’s motives for pursuing the case are political, claiming that she is “known for her leniency and alternatives to incarceration” in other cases. She faced criticism earlier this month for filing hundreds of domestic violence cases after a domestic violence accused allegedly murdered his wife with a hammer. An advocacy group called Virginians for Safe Communities is leading a recall effort against Biberaj over the affair, the Washington Free Beacon reported.
Biberaj did not immediately respond to Fox News’ request for comment.

Biberaj was one of several Soros-backed prosecutors elected in Northern Virginia in 2019 after his campaign received more than $ 860,000 from Soros’ Justice and Public Safety PAC. She is an advocate for penal reform and a member of a Commonwealth lawyer group called the Virginia Progressive Attorneys for Justice, which calls for the elimination of mandatory minimum sentences and cash bonds.
Biberaj is also a close ally of McAuliffe, who reportedly accepted a $ 250,000 contribution from Soros for his campaign in August. Biberaj, who has rented McAulliffe as being “part of the progress” Virginia needs, joined the former Democratic governor on Oct. 2 at a campaign event in Leesburg.
McAuliffe, who is running against Republican gubernatorial candidate Glenn Youngkin, has already rented Biberaj as a “champion” of criminal justice reform. He raised funds and campaigned for her in 2019, saying it would bring “real reform of criminal justice” to Virginia.
McAuliffe’s campaign did not immediately respond to Fox News’ request for comment.
