The Loudoun County, Virginia chief prosecutor was hit with a lawsuit on Thursday after a circuit court judge dismissed her office from a criminal case for “deliberately misleading the Court and the public”.
“Ms Biberaj’s conduct is utterly unbecoming of both a prosecutor and a judicial officer. Judge Plowman’s order is a damning condemnation of the Commonwealth prosecutor’s ethics and disregard for the public. “integrity of the justice system. We hope the Virginia Bar recognizes the seriousness of this misconduct and Buta Biberaj is immediately disbarred and removed from office,” Sean Kennedy, president of Virginians for Safe Communities, said Thursday in the statement. non-profit organization press release.
Virginians for Safe Communities on Thursday filed a formal complaint with the Virginia State Bar against Loudoun County Commonwealth Attorney Buta Biberaj “for breaching professional ethics under the Virginia Bar Rules of Conduct.” ‘State of Virginia’. The complaint calls for “a formal investigation and appropriate sanctions, which could include disbarment – preventing him from practicing law.”
The complaint follows Loudoun County Circuit Court Judge James Plowman evicting Biberaj’s entire office from a serial burglary case earlier this month for “deliberately misleading the Court and the public” in order to “sell” a plea deal. Plowman was previously Loudoun’s Commonwealth lawyer before Biberaj’s election in 2019,

The case involves burglary suspect Kevin Enrique Valle, who was charged with three misdemeanors for destruction of property and false identification, and two felonies for burglary following burglaries last May.
Valle got a six-month plea deal from Biberaj’s office, but Plowman said prosecutor Michele Burton offered the deal by downplaying Valle’s criminal history and not including other burglary charges against him. .
The judge said the plea agreement from the Commonwealth Attorney’s Office said the crimes took place within hours last year, which he says is “entirely inaccurate” as Valle is charged with “a 12 possible burglaries covering four counties over 10 days.”

Plowman said the prosecutor handling the case had shown she was unable to pursue the case “in accordance with professional standards.”
“Biberaj and the Loudoun County Commonwealth Attorney’s Office is hereby REMOVED AND DISQUALIFIED from further prosecution as counsel of record in this matter,” the judge wrote.
Thursday’s bar complaint points out that the Virginia State Bar states that “an attorney shall not knowingly make a false statement of fact or law to a court” and that “it is professional misconduct for a lawyer to: engage in conduct involving dishonesty, fraud, deceit or misrepresentation that impairs the lawyer’s fitness to practice law.”

“If the Law Society fails to take appropriate action, the citizens of Loudoun County will do so by exercising their right to initiate petition removal proceedings. Virginians for Safe Communities is committed [to] restore public safety to Loudoun County and the integrity of our criminal justice system. Only by removing Ms. Biberaj from office can this be achieved,” Kennedy, whose nonprofit is leading efforts to recall Biberaj, added in its comments.
Republican state Attorney General Jason Miyares on Monday sent a letter to the 20th Judicial Circuit Chief Judge saying his office is ready to help and even prosecute the case “in light of this unprecedented development.”
Biberaj told Miyares at a Tuesday press conference to “stay in your lane” and announced she would appeal Plowman’s order to the Virginia Supreme Court.
“They must order the Loudoun County Circuit Court to void this order because it was without authority and, more importantly, it did not have an opportunity for the parties to be heard,” Biberaj said.
Biberaj’s office did not respond to Fox News Digital’s request for comment on the formal complaint filed against her. His office released a statement later Thursday saying the complaint is “another fake political stunt.”
“This is another fake political stunt from a right-wing paid operative who doesn’t even live in Loudoun County,” Biberaj said in the statement. “These political actors apparently did not overcome the last election and continue to ignore the choice of voters in this community. These baseless attacks will continue to fail. The people of Loudoun County can see what it is – crooks who try to divide and destroy our community.WE will continue to protect our victims, reduce crime and save our taxpayers millions of dollars.

Kennedy said in a response provided to Fox News Digital that “Biberaj’s ad hominem attacks on private citizens are troubling but unsurprising.”
“She continues to mislead the public and deflect blame for her actions,” Kennedy added. “Biberaj’s actions are a clear violation of her professional ethics and a serious breach of public trust. Unlike Ms. Biberaj who received $922,000 in campaign funds from George Soros, no officer, board member , supporter or volunteer received a single penny in compensation for our just work in recalling and firing Ms. Biberaj.”
