Dolphins’ Xavien Howard files motion to dismiss STD lawsuit


Miami Dolphins cornerback Xavien Howard filed a motion Friday to dismiss a complaint from an unnamed woman alleging he knowingly and negligently transmitted a sexually transmitted disease to her.

Through his attorney, Alan Mensa-Wilmot, Howard called him “the epitome of a shakedown,” according to ESPN, which reported that Howard’s motion was filed two days after the plaintiff had filed her lawsuit against him in Broward County on October 26.

The complainant alleges that Howard knowingly gave her an STD during a sexual relationship lasting several years. The woman is asking for a jury trial and is suing Howard for damages in excess of $30,000, according to the lawsuit.

Howard’s motion reportedly includes a number of screenshots showing alleged text messages from the plaintiff, listed as Jane Doe, which “show very clearly that the plaintiff is nothing more than an ex- despised lover” seeking financial gain.

In the motion, Howard alleges that the plaintiff threatened him, entered his property, stalked him and spread false information about him.

Howard’s motion, according to the outlet, states that he “has his own causes of action which he intends to bring ‘Doe’ for his alleged ‘harassing tactics, defamatory statements and willful infliction and/or or neglect of emotional distress”.

It goes on to state that Howard “has the right to compel the plaintiff to disclose her identity so that he can properly face her accuser in court”, and that the plaintiff has not “satisfied the burden” that she must assume to file anonymously.

The motion, according to the outlet, also stipulates that the plaintiff must use her real name in pleadings, and that failure to do so is grounds for dismissal.

On Monday, the plaintiff’s attorneys, Bradley J. Edwards and Brittany N. Henderson, filed a motion to grant Jane Doe permission to continue anonymously.

According to ESPN, this motion indicates that Jane Doe has suffered embarrassment, humiliation and psychological trauma that “would be greatly exacerbated if her name were to come out publicly.”

Howard is a key defensive piece for Miami, which added linebacker Bradley Chubb at Tuesday’s deadline. Howard started in all seven games with five passes defended and 22 tackles combined.

Howard is in the first year of his five-year, $90 million contract with the Dolphins.
