Biden’s admin agencies refuse to answer, “What is a woman?”

A handful of federal agencies in the Biden administration were unable to define the meaning of the word “woman” — in some cases, even in relation to their own uses of terms such as “women’s health” — when ‘they were interviewed by Fox News Digital.

The Biden administration’s Department of Justice (DOJ), Department of Education, Department of Housing and Urban Development (HUD), and Federal Bureau of Prisons have all been contacted by Fox News Digital to request a definition woman”. None of the agencies provided their definition or criteria for a person to be categorized as “women,” though each boasts of entire initiatives aimed at helping women and the DOJ declined to comment.

Fox News Digital has also reached out to the National Institutes of Health (NIH) to request the organization’s definition of “woman” in relation to terms such as “women’s rights” and “women’s health care.” The NIH describes itself as “the steward of medical and behavioral research for the Nation”, and its goal is “[seeking] fundamental knowledge about the nature and behavior of living systems.


When asked for the definition, the NIH directed Fox News Digital to the “sex and gender” section of its website.

“‘Sex’ refers to the biological differences between females and males, including chromosomes, sex organs, and endogenous hormonal profiles,” the NIH states on its website. “Gender” refers to socially constructed and enacted roles and behaviors that occur within a historical and cultural context and vary across societies and over time. All individuals act in many ways that meet the gender expectations of their society. With an ongoing interplay between sex and gender, health is determined by both biology and gender expression.”

However, the literature provided by the NIH has not addressed the meaning of “woman” or “women” in relation to sex and gender. Despite the frequent use of the word in their writings, no explanation is given as to whether the word “women” – as used by the NIH – is descriptive of sex or gender.

Asked for clarification, the NIH declined to comment further.

“I’m glad the page was somewhat helpful,” the NIH replied, but continued, “We have nothing more to add.”

Fox News Digital also contacted the Department of Health and Human Services (HHS) directly for comment on the matter. After two days and several responses indicating that the investigation would be addressed, HHS did not provide a response.

The HHS Office of Population Affairs released a document Thursday entitled “Gender Affirmation Care and Young People”. On the same day, the National Child Traumatic Stress Network of the Substance Abuse and Mental Health Services Administration – another subset of HHS – published a parallel document titled “Gender-affirming care is trauma-informed care”.

The HHS documents outline what they call appropriate treatments for transgender teens, including: “‘upper’ surgery – to create a typical male breast shape or breast enhancement;” and “‘Bottom’ surgery – genital or reproductive surgery, facial feminization or other procedures.”

The RAND Corporation – a think tank almost entirely funded by the US government for military policy consultation – also said it had no definition of the word “woman”, despite extensive research into the rights , women’s health and fitness.

“You’re right that RAND has done a number of studies related specifically to gender and women, but our reports primarily focus on the impacts on women of various policies or circumstances,” a spokesperson for RAND said. RAND at Fox News Digital. “I don’t believe your question is one we’ve ever explicitly investigated, so I don’t have anyone to speak to. Sorry, we can’t help you further.”

Asked how RAND is able to measure or research the impacts on women of various policies without a definition of the word, RAND did not answer.

RAND receives approximately $68.4 million in funding from HHS, and more than 70% of their funding comes from US government agencies.

She said Biden administration agencies including the DOJ, HHS, HUD and others “have all announced that women no longer exist as a consistent category in federal administrative law.”

On Thursday, the Independent Women’s Voice, Independent Women’s Law Center, Women’s Liberation Front and other advocates introduced a “Women’s Bill of Rights” to “reserve biological sex as a separate legal category.”

A press release accompanying the announcement stated that dictionaries generally define “woman” as an “adult female human being”. Advocacy groups are concerned about “activists” who misrepresent and challenge the “biological basis of femininity”.

The issue escalated as controversial transgender swimmer Lia Thomas was cleared to compete in the NCAA Women’s Swimming Championship last month. She has beaten biological females in many of her races, which many believe can be attributed to her larger size and stature as a biological male.


During Senate hearings for Supreme Court nominee Justice Ketanji Brown Jackson last week, Sen. Marsha Blackburn, R-Tenn., asked the future justice to define the term “woman.” After a short exchange, Jackson told the senator that she couldn’t provide a definition because she was “not a biologist.”

“Can you give a definition of the word ‘woman’?” asked the senator.

“Can I give a definition? No,” Jackson replied. “I can not.”

” You can not ? Blackburn asked.

“Not in this context, I’m not a biologist,” the judge replied.

Jackson’s inability to define the word prompted a backlash from conservatives, who questioned how she would handle explicitly gender-related topics if confirmed as a Supreme Court justice.
