HOUSTON, Texas (KTRK) – The number of lawsuits in the Astroworld tragedy continues to rise. One of the latest lawsuits was filed by the family of 23-year-old Rudy Peña.

Rudy Peña died of injuries sustained during the Astroworld festival concert on November 5. More than three weeks later, her family still have so many unanswered questions.

“It’s difficult because he wasn’t supposed to die like this,” said his sister Jennifer Peña. “He was special. He was brilliant. He was smiling. He was a happy person. That’s why it hurts.”

Pushed and positive, Rudy’s sister told ABC13 he had a bright future. He worked and went to school, studying criminal justice. He eventually wanted to work for Border Patrol.

“He was an inspiring person,” Jennifer said when the family visited Houston. “He brightened our hearts every day.

His family still don’t know for sure what killed Rudy. It’s one of the many questions they ask themselves, and it’s the lack of resolve that haunts them.

“We need an answer,” Jennifer said. “This is what we need.”

The Peña family filed a complaint alleging unsafe conditions. Their attorneys confirm that Travis Scott’s attorney contacted in writing and offered to pay for Rudy’s funeral, as well as meet with the family personally. They haven’t had time to respond to either of these offers because they’re too busy mourning a loss that they still can’t understand.

“We will know more about who did what, who did not act,” said lawyer Valeria Cortinas Fisher. “As a result, Rudy and nine other people lost their lives.”

Their is one of hundreds of lawsuits brought by thousands of plaintiffs. As of Monday, more than 270 lawsuits were listed on the Harris County District Court website. The civil investigation widens as the criminal investigation progresses. Houston Police told ABC13 on Monday afternoon that they did not have any updates but were still the lead agency.

“With both, the civil and the criminal being launched at the same time, there is so much information,” said Rosendo Almaraz, another lawyer representing the Peña family. “So many parties involved that working cohesively and contributing to each other’s investigations, I think, will produce more than likely similar results.”

Pending a criminal or civil resolution, all the Peña family can do is mourn the loss of a young man who had so much potential, who went to a concert and never returned. at home.
